Mayor Michael Bloomberg approved legislation making it illegal for kids under 21 to carry graffiti instruments in unlocked containers.

The law, authored by City Councilmember Peter F. Vallone Jr., outlaws the possession of graffiti instruments in public places by people under the age 21. Under the new bill, it will be a criminal violation to carry spray paint, broad-tipped markers or etching acid unless it is enclosed in a locked container, or if the tools are needed for educational or professional purposes.

"The truth is that graffiti defaces our beautiful neighborhoods and sends the message that we don't care about our communities. We must make every effort to stop it," Bloomberg said at the signing.

The legislation is based on a bill that Vallone passed in 2005, which was challenged in court by proponents of graffiti. The courts issued an injunction prohibiting the city from enforcing the law, expressing concern that the amendments imposed too heavy a burden on free speech. Wanting to spare taxpayers an expensive legal battle, the city decided to draft a new bill tailored to meet the court's arguments.

"An opponent of this law would have to argue that people under 21 need immediate, unfettered access to graffiti tools at all times. That's simply ridiculous," Vallone said. "Murals take hours, but a tag can be done in seconds. We want to put this crime down before it 'gets up'."

Jimmy Oddo, minority leader of the city council, co-sponsor of the bill and ally in the battle against graffiti, added, "One thing you can say about these graffiti vandals is they are tenacious. We are lucky to have Peter Vallone Jr. to match their tenacity in this fight."

"The mayor and I are like the Frito Lay of anti-graffiti laws," joked Vallone at the signing, referring to the old commercial slogan, "It doesn't matter what they do to them, we'll just keep making more."

in caz ca nu stiati, anul trecut a fost arestat in ny un graffer pe nume kiko. amaratul a atras atentia dupa ce a tagat tot ce a putut intr-o anumita zona a orasului si vallone, inamicul nr 1 al scenei graf din ny, s-a hotarat sa il dea exemplu. asa ca a facut tot posibilul sa il gaseasca si sa il crucifice in ziare si la teve. a mers atat de departe incat, dupa ce judecatorul i-a aplicat o pedeapsa de 6 luni puscarie, 5 ani sub observatie si o amenda de 25000$, sa ceara pt el puscarie intre 1 si 3 ani. ce e si mai grav e ca s-a stabilit acum un precedent, kiko fiind primul graffer condamnat pt acte de vandalism si chiar sa faca puscarie, in locul muncii in folosul comunitatii.

As reported in today's NY Daily News, KIKO, a 28 year-old graffiti writer, was sentenced to 6 months in prison and forced to pay a $25,000 fine for his recent tagging spree in Astoria. Fanatical anti-graffiti critic and name recognition councilman Peter Vallone Jr., who once proclaimed, “I want this punk, and I want him bad… Catching this guy has been a personal vendetta of mine for a few months now" is credited with supporting some of NYC's harshest graffiti laws ever, some of which were recently struck down as unconstitutional. He has used this issue as his personal soapbox for the past year or so, totally generating more press for himself than anything else he’s done. Although we do think KIKO should be punished in some form or another, specifically public service, we don’t think that any graffiti writer should ever have to serve jail time. In the long run this hurts the community more than any tag could. If anybody wants to do any peaceful renovations demonstrations, we suggest they travel to the belly of the beast. ideea de baza e ca un writer, kiko, si-a ridicat mult numele in ultimii ani si la fel si dorinta politistilor de a-l prinde. cand, in final, au pus mana pe el, omul a desenat un 'kiko was here', in timp ce se afla la interogatoriu, fiind evident, proba incriminatorie suprema. despre asta si multe altele din ny, vedeti in ultimul link. urmeaza o parte din articol:

A would-be Basquiat goes to prison in a misguided graffiti crackdown

An evening not so long ago, Oliver Siandre was sitting at a wooden desk in a windowless room when he started to doodle.

In Siandre's drawing, the hero, a graffiti writer, is fleeing an NYPD patrol car after having just finished spraying his "tag" on a brick wall: "Kiko." There's another "Kiko" on the second floor of the building where two smitten-looking women watch from separate windows exhorting "Kiko" on. One is yelling, "Go! Go!" The other: "You can do it!" At the bottom of the picture is a third "Kiko" tag with "Busted 10/4/05" written next to it.

Siandre scratched it out killing time between rounds of questioning by detectives inside Astoria's 114th Precinct. Upon seeing the doodle, the cops laughed so hard they nearly cried. They'd witnessed plenty of written and spoken confessions but had never seen a suspect produce an incriminating drawing.

They photocopied the picture and added it to the large pile of evidence already collected against Siandre. Then they called headquarters with the news that "Kiko," the city's "most notorious graffiti vandal," had been caught.
